TERMS OF SERVICE

Welcome to ParkYoRide (“ParkYoRide,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the ParkYoRide website, apps, and services (the “Services”). By using the Services, you agree to these Terms.
- What ParkYoRide Is (and Isn’t)
- ParkYoRide is a marketplace platform that connects Hosts (people who offer a private parking space) with Parkers (people who book and pay to use that space).
- We do not own, operate, patrol, guard, or manage any spaces. Each booking is a limited, revocable license to use a space not a lease or tenancy.
- Eligibility & Accounts
- You must be legally able to enter a contract and provide accurate information.
- You are responsible for your account activity and keeping your credentials secure.
- Host Responsibilities
- You represent you have the right to offer the space (e.g., you’re the owner or authorized; any HOA/landlord rules are followed).
- Provide accurate descriptions, address/pin, photos (minimum 2), capacity (how many cars), and availability.
- Keep the space accessible and safe at the times shown.
- Set a clear price and mark any Event Day dates if applicable.
- Parker Responsibilities
- Arrive on time and park only in the space listed.
- Follow property rules, respect neighbors, and do not block driveways, sidewalks, or fire lanes.
- Keep vehicle details (make/color and license plate) up to date.
- Bookings, Check-In, No-Show & Cancellations
- Check In: On arrival, open your booking and tap “I’ve arrived” (location on). We may request a quick verifying photo.

No Show (Parker): If you don’t complete check-in within 15 minutes of start time and don’t contact the host/support, the booking is a no-show.
• Hourly (≤24h): We retain 100% of the first 2 hours (or 100% if the booking is 2h or less). Remainder is refunded/credited.
• Daily (4–24h): We retain 50% of the day. Remainder refunded/credited.
• Multi-day (2–6 days): We retain Day 1 only. Remaining days refunded/credited.
• Monthly: We retain Day 1 + 10% admin fee on unused days (cap $50). Remaining days refunded/credited.
• Event Day: If a listing is marked as an Event Day, Day 1 is retained. - Evidence: We may request a timestamped photo of the empty space from the host between Start+15 and Start+60 minutes.
- Blocked/Inaccessible space: If the space is blocked or inaccessible and the parker reports it within 15 minutes with a timestamped photo, we will refund or relocate the booking.

Cancellations:
• Free until 24 hours before start time.
• Inside 24h: Hourly retain first 2 hours; Daily retain 50% of the day; Multi day retain Day 1; Monthly retain Day 1 + 10% admin fee (max $50). - First-time courtesy: Once per account, we may convert the retained portion to site credit if you contact support within 24h.
- Payments, Fees & Payouts
- Payments are processed by our payment partner (e.g., Stripe). ParkYoRide may charge a service/platform fee (typically 10%) that is disclosed at checkout or in your host dashboard.
- Payouts to hosts follow the payment partner’s schedule and are subject to successful onboarding/KYC.
- Refund timing: Banks can take 5–10 business days to post refunds; site credit may be faster where available.
- You authorize ParkYoRide to collect, hold, and remit amounts per these Terms, including adjustments for refunds, disputes, and policy outcomes.
- Prohibited Activities
- Misrepresenting a space, capacity, or availability; unsafe or unlawful parking; harassment or discrimination; tampering with photos, timestamps, or location; using bots or scraping; or any action that interferes with the platform or other users.
- Safety
- If you feel unsafe or there’s an emergency, contact local authorities first. ParkYoRide does not provide security services. Follow posted laws and property rules at all times.
- Disputes, Evidence & Chargebacks
- Keep communications in-app and provide photos/timestamps when requested.
- If a payment dispute/chargeback occurs, ParkYoRide may submit an evidence packet (booking data, photos, messages, and check-in/out activity). Outcomes are determined by the payment network/bank.
- Suspension, Termination & Ranking
- We may pause listings, withhold payouts, de-rank, or suspend accounts for policy violations, fraud risk, unsafe behavior, excessive cancellations/no-shows, or non-compliance with payment onboarding.
- Intellectual Property
- ParkYoRide owns the platform, trademarks, and content we create. Users grant ParkYoRide a limited license to display listing content for operating the Services.
- Disclaimers
- The Services are provided “as is” and “as available.” We make no warranties regarding availability, accuracy, or suitability of spaces. Hosts manage their property; parkers are responsible for their vehicles, tickets, and conduct.
- Limitation of Liability
- To the maximum extent permitted by law, ParkYoRide and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any amount exceeding the greater of: (a) fees you paid to ParkYoRide in the three (3) months before the event giving rise to the claim, or (b) $100.
- Indemnification
- You agree to defend, indemnify, and hold harmless ParkYoRide from claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your listings or bookings, or your violation of these Terms or any law.
- Governing Law & Venue (New Mexico)
- These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law principles.
- You agree that the exclusive venue for any action arising out of or relating to these Terms or the Services will be the state courts located in Bernalillo County, New Mexico or the U.S. District Court for the District of New Mexico (Albuquerque), and you consent to the personal jurisdiction of those courts.
- Changes to These Terms
- We may update these Terms. When we do, we’ll change the Effective Date and, where required, notify you. Your continued use of the Services after changes means you accept the updated Terms.
